Ms. Garger is Of Counsel with Ogletree, Deakins, Nash, Smoak & Stewart, P.C. and represents and counsels employers with employment issues, including employee discipline and termination, wrongful discharge cases, employment discrimination complaints, religious and disability accommodation issues, sex harassment investigations, revising employee manuals and related employment policies.
Ms. Garger currently devotes the majority of her practice to representing federal contractors and subcontractors in compliance evaluations and administrative enforcement actions brought by the United States Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP). Ms. Garger represents employers in a wide range of industries, including food processing, manufacturing, transportation, healthcare, pharmaceutical, hospitality, financial, educational, technology, retail and construction around the country on the preparation, management, and defense of their affirmative action programs and related matters, including jurisdictional analyses and preventative strategies.
Ms. Garger is regularly involved with investigating and resolving systemic discrimination issues stemming from statistical disparities in hiring, promotion, termination, and compensation and has extensive experience negotiating and defending allegations of back pay liability and other sanctions imposed by the OFCCP. Additionally, Ms. Garger advises employers on compensation analyses and audits, development of diversity programs, and EEO-1 and Protected Veterans reporting issues.
Prior to Ogletree, Ms. Garger practiced with international law firms in Phoenix and Chicago. She has litigated discrimination claims before federal and state courts, and various administrative agencies and tribunals, on behalf of employers around the country. Ms. Garger is a member of the Arizona, Connecticut, and Illinois (trial bar) state bars, various U.S. District Courts, and the U.S. Court of Appeals for the Seventh Circuit.
